Hunter v. Realty Experts, LLC. (2014)

Our law firm represented Plaintiff, a real estate agent, in seeking emergency relief from her employer’s restrictive covenant in their employment agreement after the employer constructively terminated Plaintiff’s employment. The basis of the constructive termination was the employer’s sexual harassment of Plaintiff.

After Plaintiff left and received an immediate job offer elsewhere, Defendant employer tried to enforce a covenant not to compete, previously signed by Plaintiff. Plaintiff filed an Order to Show Cause seeking immediate relief based on the employer’s sexual harassment. We argued that an employer cannot force an employee to quit, and then seek to hold her to the terms of a restrictive covenant that stops her from earning a living.

The employer settled the case as soon as the Plaintiff filed her Order to Show Cause. The case settled on terms favorable to Plaintiff.
