Carol O’Donohue adv. Hunterdon Builders (2011)

Hanan M. Isaacs represented the defendant, Ms. O’Donohue, in this former employer’s civil suit for reimbursement based upon defendant’s alleged fraudulent use of a credit card. We were able to prove at trial that the employer’s claim was untrue; our client had permission to use the credit card for business purposes, including for car fuel; and that the employer had unilaterally changed its mind to save money, thereby significantly changing the terms of employment. Employee walked off the job, and employer declared that she had quit. Our theory of the case was that employer became increasingly hostile and accusatory when its former employee began making Unemployment Compensation claims. The trial judge dismissed Hunterdon Builder’s claim and entered a judgment for our grateful client.
