Caldwell v. Caldwell (2017)

In this heartbreaking custody and parenting time matter, in which we represented Betty, the former wife, a Judge prematurely allowed the father to relocate out-of-state with the parties’ two children.

We filed emergent appeals to the New Jersey Appellate Division and Supreme Court, asking for a stay of the relocation pending trial. Those appeals were denied. However, we were able to persuade the father and his lawyer that both sides could save tremendous counsel fees, time, and stress by approaching the matter cooperatively in mediation and, if necessary, arbitration, both with the same retired Judge.

We entered into that arrangement and successfully negotiated significant additional parenting time for Betty, who continued to live and work in Middlesex County.

Betty’s relationship with the children is excellent. She sees them regularly and has them for almost the entire summer vacation from school.

This was an excellent result under unfavorable circumstances, and our client and the children have recovered well from the ordeal.
