Cynthia Polar v. William Polar (2018)

 

In this divorce action, this office represented Cynthia Polar, wife, against Bill Polar, husband.

In an otherwise unremarkable case, division of marital retirement funds took over a year.

During the divorce, the parties agreed to split Cynthia’s 401k and retirement savings plan.  However, they agreed only after the divorce was entered to divide the asset by making a lump sum payment.  Cynthia’s retirement savings plan refused the lump sum payment. Once Cynthia accepted a buyout and the marital settlement agreement called it a retirement savings plan, the plan administrator wouldn’t accept transfer by Qualified Domestic Relations Order.  Our lawyers had to draft a consent order, then amend the marital settlement agreement to reflect the updated source of funds. The financial institution was uncooperative in their responses. Diligence and persistence by legal counsel from our office successfully achieved out client’s goal.
