LGBT Workers: Fed Contractors Must Not Discriminate Against You!!

Americans are protected from workplace discrimination. Previously, federal contractors and subcontractors were not allowed to discriminate against employees on the basis of religion, color, race, sex, disability, national origin or status as a protected veteran. Recently, another class was added to that list: workers who are lesbian, gay, bisexual, or transgender.

The Executive Order

President Obama granted these protections by Executive Order.The changes apply to federal contractors and subcontractors throughout the nation, including those located here in New Jersey.

Forms of discrimination

As with any type of workplace discrimination, LGBT discrimination could occur in the following situations:

  • Retaliation
  • Sex stereotyping
  • Gender expression
  • Identity expression
  • Sexual preference

Conclusion

For many federal contractors, the Executive Order will not change anything, because they already have policies in place that ban discrimination based upon gender identity or sexual orientation. However, as we have seen too often, what appears on paper is not necessarily what happens in the day to day workplace.
