Collaborative Law
Central New Jersey Collaborative Law Lawyer
Collaborative law is a relatively new form of alternative dispute resolution that has taken hold largely in the area of family law. However, it has become such a successful approach for those parties looking to reach a mutually beneficial agreement that it may expand into other areas of law such as business law or employment law.
With more than 35 years of legal experience, the New Jersey collaborative law attorneys at Kingston Law Group, can help you understand the collaborative approach. Attorney Hanan Isaacs is trained in collaborative law and will work with you to determine if this is the right course of action for you.
Call 866-959-3786 or send us an e-mail to arrange for a consultation about family law, business or employment arbitration.
Committing to Reaching an Agreement
Like other forms of alternative dispute resolution, collaborative law can reduce the stress and cost of going to trial. What sets collaborative law apart, however, is the commitment to reaching settlement without resorting to litigation.
At the start of the collaborative law process, both parties and their respective counsel sign an agreement. This agreement outlines their commitment to the negotiations by requiring both parties to seek new representation if the case ends up in litigation. This does not bar you from pursuing mediation or arbitration after using collaborative law or, conversely, using collaborative law after other forms of alternative dispute resolution have proved unsuccessful.
Maintaining Open Communication for Families
Collaborative law is beneficial to those involved in a family law dispute or divorce because it fosters open communication and mutual agreement. In collaborative law, our lawyers take on a different role than that of a zealous advocate. In this approach, each attorney must take into consideration the needs and goals of both parties and their children. Everyone works together to reach a mutually beneficial solution. By working through disagreements now, and taking control over the decisions that will affect you and your family in the future, you can avoid future disputes and maintain ongoing relationships.
